Congress passed the No Surprises Act in 2020 to protect patients from surprise bills and ensure appropriate payment by Big Insurance for medical care.
Since then, Big Insurance has been working to undermine this landmark legislation by terminating contracts, slashing reimbursement, and putting patient access at risk. As a result, it’s crucial for Congress to advance the No Surprises Act Enforcement Act (H.R. 4710/S.2420) as introduced – WITHOUT the changes Big Insurance wants for even bigger profits!

PAYMENT
Authorises penalties for any party that fails to comply with payment timelines after a final, binding arbitration decision.
ENFORCEMENT
Grants federal regulators explicit authority to enforce IDR rulings, closing the gap that lets a plan ignore a decision with no consequence.
PENALTIES
Increases civil monetary penalties for Big Insurance and group health plans that violate balance-billing requirements.
TRANSPARENCY
Requires regulators to report every six months on enforcement actions, penalties issued, and the most common violations.

Advance the No Surprises Act Enforcement Act (H.R. 4710/S.2420) As Introduced WITHOUT Big Insurance Poison Pills.
As physicians and clinicians who care for patients across every state and specialty, we strongly support the No Surprises Act’s promise. The bill was passed to ensure patients are protected from surprise bills and to resolve disputes between physicians and Big Insurance through a neutral, binding arbitration process.
Unfortunately, those safeguards are under attack. Big Insurance is systematically terminating contracts, slashing rates, and putting patient access at risk. It frequently tries to pay less than one dollar for complex, life-saving medical care. It is also undermining the Independent Dispute Resolution process Congress created — paying late, paying short, and in some cases not paying at all — all in defiance of the law.
We therefore call on Congress to advance H.R. 4710 / S.2420 and to schedule it for a vote, so that Big Insurance can no longer default or delay without consequence.
The No Surprises Act needs to work the way Congress intended — for patients as well as the physicians and clinicians on whom they depend.
